Terms

Before I continue, I would like to define some words so that there is no confusion about the way topics are discussed in my TOS.

Model, the person in front of the camera being photographed.
Compensation, a reward or service for being a photographer and making photographs.

Compensation

As a photographer, I do not require any compensation. This is because I feel like my photos are not yet on the level where I feel comfortable charging money for it. In this case, I do appreciate any gifts or services if offered, but please discuss this beforehand.

For distances further than 40 kilometers by car, I do ask financial compensation. To calculate the distance, I assume the city I currently reside in. A part of this compensation (35%) is required to be paid if discussed before the photoshoot, and the latter part (65%) is to be paid after the photoshoot before receiving the photographs. The pre-payment is required 24 hours before the photoshoot. Without this payment, I do not come to the photoshoot, even if you show up. Cancelation is possible but also at least 24 hours before the photoshoot.

The formula to calculate this is:

Usage of the photos

As I do not charge anything for my photos, I do add a watermark so that the photos are not stolen or get posted uncredited. Although it may be needed to crop a photo, try to keep my watermark fully visible, or credit me in another way. I am always open to crop the photo myself so that the watermark stays fully visible.

As the photo has my watermark on it, it should represent my work and what I create. This means that I do not allow post-effects on my photos besides the edits I have done myself. In the case you want a certain effect, please ask me if I can do it. This way I retain full control over my own work without someone changing what I have created.

As my photos require credits, not giving credits will result in a private message asking to correct it. If you do not correct it, I will also publicly ask you to correct it, and if that also is not requested, I will try to get the photo(s) taken off the internet

Any not allowed commercial use is fully banned. Please contact me if you want to use one or multiple of my photos.

Conduct of client

Before the photoshoot, I believe it is important for me to know what I am walking into. I would like to know how many people will be photographed, what kind of cosplay or photoshoot it will be, and any ideas you have for photos.

While I do like doing things for others, I do expect you to be at the location at the time we have agreed upon. In the case you will run late, please let me know. If you are not at the location one hour after we have agreed upon, I will leave the location of the photoshoot and will ask for the full amount of the travel compensation of the photoshoot if it is applied on the photoshoot.

I expect everyone at the photoshoot to act responsible and respectful to each other and to me. In the case this is not the case, I have the right to cancel the photoshoot. In this case, I will ask for the full amount of the travel compensation of the photoshoot if it is applied on the photoshoot.

While I am open to do NSFW photography, I expect this to be mentioned before the photoshoot if this is the case. I do not do anything NSFW with anyone below the age of 18 in presence or as the subject of the photo. In the case this is attempted, I will ask for the full amount of the travel compensation of the photoshoot if it is applied on the photoshoot.

Retrieval of photos

Photos from a private photoshoot will stay private unless you also share photos online of the photoshoot. The photos will be shared privately once they are done, and you can request changes if you want after this. You can also allow me to post certain photos to my portfolio website. Posting any photo online means I too am allowed to post this photo on my portfolio website and my portfolio social media accounts. Photos can be kept private.

Photos from a public photoshoot, event or convention will become public when I am done with them. These images can be retrieved by anyone and are free to use as long as you follow my guidelines for the sharing of photos. Requesting changes is possible through contacting me.

Bans

While I do not like banning people, I am fully allowed to ban someone from a photoshoot, or from my services. Banning can happen because of many reasons, and I can choose who to ban whenever I want. Bans are often applied if someone is doing something illegal, online or in the real world, if credits were not given in previous instances, as well as hateful online behaviour. While I won't personally send someone a message if they are banned, I will potentially decline sharing photos with the banned person, and ban them from photoshoots.
